NOTICE IS HEREBY GIVEN THAT the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Marlin Lewis, Petitioner/Unit Owner, In RE: The Grand Condominium Association, Inc., Docket No. 2008055186. The petition seeks the agency’s opinion as to the applicability of Chapter 718, Florida Statutes, as it applies to the petitioner.

Whether the board of directors of The Grand Condominium Association, Inc. may approve a commercial unit owner’s construction on the common elements of a 7,000 square foot enclosed concrete deck without a vote of the unit owners under Section 718.113(2)(a), Florida Statutes.
