The Board of Nursing Home Administrators hereby gives notice:

Of the issuance of an Order regarding the Petition for Variance or Waiver, filed on April 26, 2016 by Christopher Brookshire. The Notice was published in Vol. 42, No. 85, of the May 2, 2016, Florida Administrative Register. Petitioner sought a variance or waiver of the requirement of subsection 64B10-15.001(2), Florida Administrative Code, that licensees have specified hours of continuing education as a condition of biennial licensure renewal. The Board considered the instant Petition at a duly-noticed public meeting held on June 24, 2016. The Board’s Order, filed on August 31, 2016, determined that the Petitioner has demonstrated he met the purpose of the underlying statute by other means and demonstrated that application of the rule at issue would constitute a substantial hardship. The Order granted the petition in part, allowing Petitioner to complete all required CE via web-based, video or audio-transmitted, on-line, or home study programs.
