    NOTICE IS HEREBY GIVEN that the Board of Opticianry has received the petition for declaratory statement from Kelly Wilse, filed on October 11, 2013. The petition seeks the agency's opinion as to the applicability of Section 484.002(3), Florida Statutes as it applies to the petitioner.

    The petition seeks the Board’s interpretation of Section 484.002(3), Florida Statutes, and whether the taking of payment of a sales transaction when the optician is not on the premises, where no optical device has been interpreted, measured, prepared or dispensed to a patient is considered the practice of opticianry. Except for good cause shown, motions for leave to intervene must be filed within 21 days after publication of this notice The Board will address this Petition at its next meeting.
