    NOTICE IS HEREBY GIVEN that the Division of Pari-Mutuel Wagering, Department of Business and Professional Regulation, has issued an order disposing of the petition for declaratory statement filed by Calder Race Course, Inc., as Petitioner, and Florida Thoroughbred Breeders Association, Inc. d/b/a Florida Thoroughbred Breeders and Owners' Association and Ocala Breederss Sales Company, Inc., as Intervenors, on October 23, 2018. The following is a summary of the agencys disposition of the petition:

    Petitioner, Calder Race Course, Inc.’s Petition for Declaratory Statement is granted. Petitioner’s Question 1 is answered in the affirmative. Calder may operate a full schedule of jai alai performances and maintain its “eligible facility” status to operate slot machine gaming. Petitioner’s Question 2 is answered in the negative. Petitioner is not required to conduct summer jai alai performances in the state fiscal year preceding operation of slot machines as a summer jai alai licensee.
