    The Emergency Communications Board hereby gives notice:

    of the issuance of an Order regarding the Petition for Variance or Waiver for Martin County, filed on September 28, 2023. The Notice of Petition for Variance or Waiver was published in Volume 49, No. 157, of the August 14, 2023, Florida Administrative Register. The Petitioner sought a variance or waiver of paragraph 60FF1-5.003(2)(a), F.A.C., entitled “911 Grant Programs” which establishes timeframes for completion of projects that are supported by grants. The underlying statutes 365.172(6)(a)3.b., F.S., which establishes a grant program to assist Florida Counties with upgrading emergency communications systems; and 365.173(2)(g), F.S., which allows the Board to establish priorities for awarding grants to develop and maintain emergency communications systems. The Board considered the Petition at a duly-noticed meeting on August 16-17, 2023. The Board’s Order, filed on September 28, 2023, grants the Petition for variance or waiver, finding that Petitioner has complied with the requirements of subsection 120.542(2) of the Florida Statutes. Specifically, Petitioner has demonstrated how the purpose of the underlying statutes, 365.172(6)(a)3.b., F.S. and 365.173(2)(g), F.S., would be achieved. Additionally, Petitioner has demonstrated that failure of the Emergency Communications Board to grant Martin County’s petition would cause a substantial hardship for petitioner. Based upon the foregoing, the Board determined that Petitioner is eligible for a variance or waiver of paragraph 60FF1-5.003, (2)(a), F.A.C.
