The Board of Medicine hereby gives notice that it has received a Petition for Declaratory Statement filed on behalf of Scott H. Plantz, M.D., on October 10, 2007. The Petitioner, an emergency room physician, seeks the Board’s opinion as to whether the writing of a prescription for one non-scheduled pill; for multiple non-scheduled medications, to be dispensed directly to the Petitioner for the sole purpose of the First Defender XL would constitute a violation of Section 456.072(1)(gg), 458.331(1)(q) or (r), Florida Statutes, as set forth in the Petition. The Board will consider this petition at its meeting scheduled for December 1, 2007, in Orlando, Florida.
