PURPOSE AND EFFECT: The purpose of this rulemaking is to respond to a Petition to Initiate Rulemaking filed by Associated Industries of Florida pursuant to Section 120.54(7), F.S. The effect of initiating rulemaking will be to begin the necessary dialogue among various interested stakeholders to discuss proposed amendments to the rules governing the Risk-Based Corrective Action (RBCA) process at contaminated sites in Florida.
SUBJECT AREA TO BE ADDRESSED: The subject areas to be addressed include the FDEPs RBCA guidance documents, in particular the Technical Report: Development of Cleanup Target Levels (CTLs) for Chapter 62-777, F.A.C. (February 2005). Additional subject areas to be addressed include the site assessment process, fate and transport modeling and statistical methods, the risk assessment process including the criteria for allowing the use of probabilistic risk assessment, and the criteria for achieving the No Further Action status at contaminated sites (with or without controls).
