    NOTICE IS HEREBY GIVEN that on October 18, 2013, the Criminal Justice Standards and Training Commission, received a petition for a temporary waiver of paragraphs 11B-27.002(4)(a)(b), F.A.C., by Eugene M. Kight. Petitioner wishes to waive that portion of the rule which requires an officer to obtain employment within four years of beginning basic recruit training. Petitioner began basic recruit training on February 15, 2010. He passed the State Officer Certification Examination in September of 2010 after successfully completing basic recruit training September 16, 2010. The Petitioner asserts that he could not obtain employment within the four year window because of family health issues which took him out of state for two years beginning in April of 2011. The Petitioner did not return to Florida to begin searching for employment until he returned to Florida in 2013. The Petition states that the operation of the rule would violate the principles of fairness because Petitioner had to care for ailing family members in Maryland for two years during which time he could not actively search for Florida law enforcement employment. The Petition states that the operation of the rule creates a substantial hardship for Petitioner because he has begun to seek employment with many agencies and is in the hiring process for the Palm Beach Sheriff’s Office, Coconut Creek Police Department. Petitioner further states that he has applications in at many other area agencies. Petitioner seeks an additional year from the date his four years to become employed expires, February 15, 2014, in order to secure employment. That would give him until February 15, 2015, to obtain employment.
