APPROVING ISLAMORADA ORDINANCE NO. 13-21
The Department of Economic Opportunity (“Department”) hereby issues its Final Order, pursuant to §§ 380.05(6) and 380.0552(9), Fla. Stat., approving land development regulations adopted by Islamorada, Village of Islands, Florida, Ordinance No. 13-21 (the “Ordinance”).
FINDINGS OF FACT
The Florida Keys Area is designated by § 380.0552, Fla. Stat., as an area of critical state concern. Islamorada, Village of Islands, is a local government within the Florida Keys Area.
The Ordinance was adopted by Islamorada, Village of Islands, on August 22, 2013, and transmitted to the Department on August 30, 2013, with a request that the Department not review the Ordinance until Comprehensive Plan Amendment 13-1ACSC which the Ordinance implements becomes effective. Comprehensive Plan Amendment 13-1ACSC became effective on October 18, 2013.
The Ordinance amends Chapter 30 “Land Development Regulations,” Article IV “Administrative Procedures,” Division 5 “Concurrency Management System” of the Village Code of Ordinances to adopt a countywide level of service for U.S. 1 not dependent on any single road segment, modify the level of service standards for potable water and potable water Equivalent Residential Units, delete level of service standards for on-site systems (BAT) community wastewater collection and treatment systems, and remove obsolete references to former Chapter 9J-5, Fla. Admin. Code. The Ordinance implements Village Comprehensive Plan Amendment 13-1ACSC identified above.
CONCLUSIONS OF LAW
The Department is required to approve or reject land development regulations that are adopted by any local government in an area of critical state concern. §§ 380.05(6) and (11) and § 380.0552(9), Fla. Stat.
“Land development regulations” include local zoning, subdivision, building, and other regulations controlling the development of land. § 380.031(8), Fla. Stat. The regulations adopted by the Ordinance are land development regulations.
All land development regulations enacted, amended, or rescinded within an area of critical state concern must be consistent with the principles for guiding development for that area. §§ 380.05(6) and 380.0552(9), Fla. Stat. The Principles for Guiding Development for the Florida Keys Area of Critical State Concern are set forth in § 380.0552(7), Fla. Stat.
The Ordinance is consistent with the Islamorada, Village of Islands, Comprehensive Plan Policies 2-1.2.1, 4-1.1.1, and 4-1.1.3.
The Ordinance is consistent with the Principles for Guiding Development in section 380.0552(7), Fla. Stat., as a whole, and is specifically consistent the following Principles:
(a)Strengthening local government capabilities for managing land use and development so that local government is able to achieve these objectives without continuing the area of critical state concern designation.
(n)Protecting the public health, safety, and welfare of the citizens of the Florida Keys and maintaining the Florida Keys as a unique Florida resource.
WHEREFORE, IT IS ORDERED that the Department finds that Islamorada, Village of Islands, Ordinance No. 13-21 is consistent with the Principles for Guiding Development for the Florida Keys Area of Critical State Concern and is hereby APPROVED.
This Order becomes effective 21 days after publication in the Florida Administrative Register unless a petition is timely filed as described in the Notice of Administrative Rights below.
