Notice is hereby given that the Board of Medicine has received a Petition for Declaratory Statement filed by Gary M. Reisfield, M.D, on October 27, 2014. The Petitioner seeks the Board’s interpretation of Section 458.331(1)(f), (g), (q), (t), and (w), F.S., with regard to whether Petitioner may prescribe an opioid antagonist (as set forth in the Petition) to his patients at risk of experiencing an opioid overdose for administration by a third party to that patient, via any administration route (as set forth in the Petition), without such act constituting a violation of Section 458.331(1)(f), (g), (q), (t), or (w), F.S. Additionally, the Petitioner seeks the Board’s interpretation as to whether he may teach (either directly or indirectly through a person qualified by training, experience or licensure) overdose prevention and response education (including how to administer an opioid antagonist) to his patients or other persons in a position to assist his patients at risk of experiencing an opioid overdose, without such act by Petitioner constituting violation of Section 458.331(1)(f), (g), (q), (t), or (w), F.S. The Board will consider this petition at its meeting currently scheduled for December 5, 2014. Except for good cause shown, motions for leave to intervene must be filed within 21 days after publication of this notice.
