    PURPOSE AND EFFECT: The purpose of the rule amendment is to update the rule text.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: Because the amendments will expand eligibility for licensure by endorsement, there will be no adverse impact on small business nor increase in costs to any entity in excess of $200,000 within 1 year; further, legislative ratification will not be necessary, as costs will not to exceed $1 million in 5 years.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    THE FULL TEXT OF THE PROPOSED RULE IS:

     

    64B10-11.0011 Mandatory HIV/AIDS and Prevention of Medical Errors Education.

    (1) Each licensee shall be required to complete, no later than upon first licensure renewal, a Board-approved course on human immunodeficiency virus and acquired immune deficiency syndrome (HIV/AIDS). To receive Board-approval, courses on HIV/AIDS shall consist of one (1) hour of instruction, which shall be approved by any board within the Department of Health’s Medical Quality Assurance.

    (2) Each applicant as a condition of initial licensure and each licensee, as part of the licensure renewal process, shall complete a Board-approved two (2)-hour course on the prevention of medical errors, which must contain the following components: root cause analysis; error reduction; prevention and patient safety.
