    61G16-6.006: Licensure by Endorsement

    PURPOSE AND EFFECT: The rule amendment is required by HB 1193, enacted in 2020.

    SUMMARY: The requirements for licensure by endorsement will be updated due to HB 1193, enacted in 2020.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board, based upon the expertise and experience of its members, determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    THE FULL TEXT OF THE PROPOSED RULE IS:

    61G16-6.006 Licensure by Endorsement.

    (1) The following requirements apply to any applicant for endorsement who has held an active license in good standing to practice geology in a state, trust, territory, or possession of the United States:

    (a) The applicant shall meet the qualifications for licensure in Section 492.105(1)(b)- (e), Florida Statutes; and,

    (b) The applicant shall have been licensed through the examination provided by the Association of State Boards of Geology (ASBOG) in at least one state, trust, territory, or possession of the United States. The applicant shall have received a score on that examination which is equal to or greater than the score required by Florida.

    (2) The following requirements apply to applicants, who elect not to apply through subsection (1)  for endorsement, and who have held a valid license to practice geology in another state, trust, territory or possession of the United States for at least ten years before the date of application submittal, provided the license is active at the time of application submittal or has expired not more than two years prior to application submittal:

    (a) The applicant shall have passed a state, regional, national, or other examination that is equivalent to or more stringent than the ASBOG examination; or

    (b) The applicant shall be required to take the ASBOG examination in order to become licensed.

    (1) For those applicants for licensure by endorsement whose current license, certificate, or registration to practice geology was issued by a state, trust, territory, or possession of the United States that used the Association of State Boards of Geology (ASBOG) licensure examination as the written examination for licensure to practice geology in that state, trust, territory, or possession of the United States at the time of the applicant's initial licensure, the Board approves the examination requirements of the state, trust, territory, or possession of the United States as substantially equivalent to or more stringent than those of this state.

    (2) For those applicants for licensure by endorsement whose current license, certificate, or registration to practice geology was issued by a state, trust, territory, or possession of the United States that did not use the Association of State Boards of Geology (ASBOG) licensure examination as the written examination for licensure to practice geology in that state, trust, territory, or possession of the United States at the time of the applicant's initial licensure, the Board will review the specific examination requirements of the state, trust, territory, or possession of the United States as they existed at the time of the applicant's initial licensure for possible approval by the Board as being substantially equivalent to or more stringent than those of this state.

    (3) For all applicants for licensure by endorsement, the Board will review the licensure examination results for the applicant's current license, certificate, or registration to practice geology to determine if the applicant received a score on such examination which was equal to or greater than the score required for licensure by examination in the State of Florida. Only those applicants who received a score on the licensure examination for their current license, certificate, or registration which was equal to or greater than the score required by this state for licensure by examination shall be eligible for licensure as a professional geologist by endorsement.
