    RULE NO: RULE TITLE
    11B-27.00212: Maintenance of Officer Certification

    NOTICE IS HEREBY GIVEN THAT on October 7, 2008, the Criminal Justice Standards and Training Commission has issued an order.

    The order grants the petition for waiver of subsection 11B-27.00212(14), F.A.C., requested by Metropolitan Police Institute, Miami-Dade Police Department and Roberto A. Gonzalez. The rule requires all law enforcement officers to complete firearms training by June 30, 2008, and every two years thereafter. Petitioner Gonzalez was injured on duty and failed to meet his qualification on time. When he returned to duty, he had a “break-in-service” for the few weeks between June 30, 2008, and the day he returned to duty. The Petitioners wished to have this “break-in-service” deleted from Petitioner Gonzalez’s officer records. The petition was granted upon consideration of all of the evidence presented. The Commission found that the strict application of the rule to the Petitioner’s case would violate the principles of fairness and cause substantial hardship to the Petitioners. The “break-in-service” was ordered removed from Petitioner Gonzalez’s records.
