    NOTICE IS HEREBY GIVEN that Board of Cosmetology has declined to rule on the petition for declaratory statement filed by Diana Richardson on July 10, 2014. The following is a summary of the agency’s declination of the petition:

    The Notice of Petition for Declaratory Statement was published in Vol. 40, No. 157, of the August 13, 2014, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on September 4, 2014. Petitioner was requesting an interpretation of subsections 61G5-22.015(1) and 61G5-22.017(1), (2), Florida Administrative Code, regarding whether a conflict exists between the rules. The Boards Order, filed on September 30, 2014, declines to answer the Petition for Declaratory Statement. The Board determined that the Petitioner lacked standing to request a declaratory statement and was attempting to determine the conduct of another.
