NOTICE IS HEREBY GIVEN that the Division of Alcoholic Beverages and Tobacco, Department of Business and Professional Regulation, State of Florida, has issued an order denying of the Petition for Declaratory Statement filed by Astor Post No. 9986 Veterans of Foreign Wars of the United States, Docket No. 2012-067 on October 2, 2012.
On August 22, 2012, the Division received a Petition for Declaratory Statement in which the Petitioner, Astor Post No. 9986 Veterans of Foreign War of the United States, Inc., requested the agency’s opinion as to whether the agency will adopt the Attorney General’s opinion that nonprofit organizations cannot conduct sweepstakes pursuant to Florida Statues 849.094. The notice of receipt was published on the Florida Administrative Weekly website on 9/14/2012 Vol. 38/37.
On August 30, 2012, the Division received a notice of withdrawal by and through the Petitioner’s undersigned counsel hereby withdrawing its Petition for Declaratory Statement filed on August 22, 2012. Having fully considered the complete record of this case and pursuant to the request of the petitioner, the Division hereby ordered that the Petition for Declaratory Statement dated August 22, 2012, shall be dismissed.
