PURPOSE AND EFFECT: 64B15-12.001 – to clarify the examination rule. 64B15-12.003 – to adopt and incorporate by reference the application for licensure by endorsement pursuant to Section 456.0145(2), F.S. (SB 1600), update rulemaking authority and law implemented, and to clarify the rule as needed.
SUMMARY: The proposed rule amendments will clarify the rules text and incorporates the application form into the rule.
SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:
The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board concluded that this rule change will not have any impact on licensees and their businesses or the businesses that employ them. The rule will not increase any fees, business costs, personnel costs, will not decrease profit opportunities, and will not require any specialized knowledge to comply. This change will not increase any direct or indirect regulatory costs. Hence, the Board determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

(1) Pursuant to Section 456.017(1)(c), F.S., the Board hereby approves and designates the use of an examination prepared by the National Board of Osteopathic Medical Examiners as the examination prescribed by Section 459.0055, F.S., for use by the Department.

64B15-12.003 Applications for Licensure.
(1) An applicant Applications for licensure by examination or endorsement pursuant to Section 459.0055, F.S., must include a completed application form and appropriate fee as set forth in Section 459.0055, F.S., and subsection 64B15-10.002(1), F.A.C. The instructions and application form, DH-MQA 1029, (Revised 5/22), entitled “Osteopathic Physician Application For Licensure” is hereby incorporated by reference, and may be obtained from http://www.flrules.org/Gateway/reference.asp?No=Ref-14609, from the Board of Osteopathic Medicine, 4052 Bald Cypress Way, Bin #C06, Tallahassee, Florida 32399-3256, or from the website at: https://floridasosteopathicmedicine.gov/. Such application and fee shall expire one year from the date on which the application is initially received by the Board. After a period of one year a new application and fee must be submitted.
(2) An applicant for licensure by endorsement pursuant to section 456.0145(2), F.S., shall submit as part of his or her application DH-MQA-5103 Mobile Opportunity by Interstate Licensure Endorsement (MOBILE) (eff. 7/2024), which is incorporated herein by reference and which may be obtained from http://www.flrules.org/Gateway/reference.asp?No=Ref, the Board office, or at https://floridasosteopathicmedicine.gov/resources/. Applicants for licensure shall meet and comply with all requirements in Section 456.0145(2), F.S.
(3) Such application and fee shall expire one year from the date on which the application is initially received by the Board. After a period of one year a new application and fee must be submitted.
