    PURPOSE AND EFFECT: The purpose of the proposed rule amendment is to establish regulations for taking migratory birds other than ducks and coots in conformance with federal regulations. Rule wording would be changed to increase the daily bag limit of canvasbacks from one per day to two per day.

    SUMMARY: This rule amends regulations of ducks, geese, and coots.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The nature of the rule and the preliminary analysis conducted to determine whether a SERC was required

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    68A-13.003 Hunting Regulations for Ducks, Geese, and Coots.

    The Commission has approved the following regulations and bag limits for taking ducks, geese, and coots:

    (1) Duck, light goose, and coot season:

    (a) through (e) No change.

    (f) Limits: The possession limit for ducks and coots shall be three days’ bag limit. There shall be no possession limit for light geese. Light geese include only snow (including blue) and Ross’ geese.

    1. Ducks: The daily bag limit for ducks is six, including no more than four mallards, of which only two can be females, two scaup, four scoters, three wood ducks, two redheads, two pintails, two canvasbacks one canvasback, one black duck, one Florida duck (mottled duck), and one fulvous whistling-duck. In addition to the daily bag limit for ducks, the daily bag limit for mergansers is five, only two of which may be hooded mergansers.
