The Board of Massage Therapy hereby gives notice: of the issuance of an Order regarding the Petition for Variance or Waiver, filed on July 2, 2018 by Lisa A. Beatty/Holistic Healing Massage & Wellness. The Notice of Petition for Waiver or Variance was published in Vol. 44, No. 132, of the July 9, 2018 Florida Administrative Register. Petitioner sought a variance or waiver of paragraph 64B7-26.003(1)(d), F.A.C., regarding the use of an infrared sauna without a shower onsite as required by paragraph 64B7-26.003(1)(d), F.A.C. The Board considered the instant Petition at a duly-noticed public meeting held on July 27, 2018, Panama City Beach, Florida
The Board’s Order, filed on August 23, 2018, found that the petition was in substantial compliance with the provisions of Section 120.542, F.S. and Chapter 28-104, F.A.C., however, the Petitioner has not achieved the purpose of the underlying statute by other means, and has not demonstrated compliance with the rule would pose a substantial hardship on Petitioner. The Board denied the petition for waiver or variance of Rule 64B7-26.003, F.A.C.
