    The Department of Agriculture and Consumer Services hereby gives notice: On October 7, 2024, the Department of Agriculture and Consumer Services, received a petition for an emergency variance from the 2017 Pasteurized Milk Ordinance (PMO), adopted by reference in rule 5K-10.001, Florida Administrative Code, from Petitioner, Publix Super Markets, Inc. located in Deerfield Beach and Lakeland, Florida. Paragraph 5K-10.001(1)(a), Florida Administrative Code, adopts the PMO, which provides storage time limits for raw milk. The Commissioner of Agriculture found that there was an immediate danger to the public health, safety, or welfare, and the Department issued an Immediate Final Order Granting Petition for Emergency Variance on October 7, 2024. The Immediate Final Order allows Petitioner to store raw milk for an extended period if specified conditions are met in order to accommodate the emergency conditions created by Hurricane Milton.
