The Board of Optometry hereby gives notice that on October 28, 2016, an Order was filed on the Petition for Waiver or Variance. The Petition was filed by William A. Monaco on September 9, 2016, seeking a waiver or variance from Rule 64B13-4.001, F.A.C., regarding the requirement that passing scores for all parts of the examination be obtained within the seven-year period immediately preceding licensure application be waived. The Notice was published in Volume 41, No. 91, of the Florida Administrative Register on September 30, 2016. The Board, at its meeting held on October 14, 2016, voted to deny the Petition for Waiver or Variance finding that the Petitioner did not demonstrate a substantial hardship; that application of the rule did not violate the principles of fairness; and that the purpose of the underlying statute was not met.
