NOTICE IS HEREBY GIVEN that the Florida Building Commission has issued an order disposing of the petition for declaratory statement filed by David Porter Associates Architects, Inc., on August 20, 2018. The following is a summary of the agency's disposition of the petition: Petitioner requested an answer to the following questions, based upon the project described within its petition: 1. Does section R403.5.1 state that all single family dwellings must install hot water recirculating systems? 2. Does section R403.5.1 state that if a hot water recirculating system is installed in a single family dwelling, it then must conform to the control systems stipulated in section R403.5.1? On October 8, 2018, the Commission provided the following answers: In response to Petitioner’s question 1, the answer is no. The requirements of section R403.5.1, Florida Building Code, Energy Conservation, 6th Edition (2017), do not apply to the project in question. This section is mandatory if a heated water circulation system is installed. In response to Petitioner’s question 2, the answer is yes. The requirements of section R403.5.1, Florida Building Code, Energy Conservation, 6th Edition (2017), are mandatory for a heated water circulation system.
