    NOTICE OF CHANGE

    Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 39, No. 218, November 7, 2013 issue of the Florida Administrative Register.

    Pursuant to comments from the Joint Administrative Procedures Committee, the Office notes the following changes to the proposed rule:

    The original statement of regulatory costs and legislative ratification did not contain enough information. It should read:

    "The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: 1) No requirement for a SERC was triggered under Section 120.541(1); and 2) The amendments will not exceed any one of the economic analysis criteria in a SERC, as set forth in Section 120.541(2)(a), F.S.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice."

    In the notice of proposed rule, the rulemaking authority includes the following statutes: 215.405, 560.105, 560.118, 560.209, 560.403 FS.

    In the notice of proposed rule, the law implemented includes the following statutes: 215.405, 560.118, 560.140, 560.141, 560.143, 560.1235, 560.204, 560.205, 560.209, 560.303, 560.307, 560.403, 943.053 FS.

    69V-560.102(4): The URL of the REAL system will be added to this section of the proposed rule. It will read:

    (4)(3) Withdrawal of Application. An application may be withdrawn if the applicant submits a written request through the REAL system (https://real.flofr.com/) for same before the application is approved or denied.”
