    PURPOSE AND EFFECT: The Pollution Response Action Contracts for the Waste Cleanup Program establishes a process for competitive procurement of multiple pollution response action contractors under a single solicitation for the Waste Cleanup Program. The Department is not modifying the process and is only proposing to remove provisions from each rule requiring the Department to review the rules every four years. Upon review, it has been determined that Section 287.0595, F.S., requires Chapter 62-787, F.A.C., stating that the Department shall establish, by adopting administrative rules, pollution response action contracts.

    SUBJECT AREA TO BE ADDRESSED: The Department’s review of Chapter 62-787, F.A.C., and determination that the rules are still necessary and required per Section 287.0595, F.S., and therefore proposing to delete provisions from each rule requiring that they be reviewed by the Department every four years to determine if they need to be repealed.
