DEPARTMENT OF ENVIRONMENTAL PROTECTION

The Department of Environmental Protection hereby gives notice:

On November 10, 2014, the Florida Department of Environmental Protection issued an order granting a petition filed by Orange County Environmental, L.L.C., on October 8, 2014, seeking a variance or waiver under Section 120.542, Florida Statutes, for its construction and demolition debris disposal and recycling facility located at 7902 Avalon Road, Winter Garden, Florida. The Petitioner requested a waiver from paragraphs 62-701.630(3)(a) and 62-7.1.630(3)(b), Florida Administrative Code, which require the owner or operator of a solid waste disposal facility to provide closing cost estimates for financial assurance that are based upon a third party performing the work and require the owner or operator include the costs of cover soils rather than allowing the use of on-site soils. The Order, OGC Number 14-0562, granted the waiver of paragraphs 62-701.630(3)(a) and 62-7.1.630(3)(b) based on a showing that the Petitioner demonstrated that a strict application of the rules would result in substantial hardship and that the purpose of the underlying statute will be or has been achieved by other means. Notice of receipt of the petition was published in the Florida Administrative Register on October 10, 2014. No comments were received.
