The Board’s Final Order, filed in this matter on October 31, 2006, finds that the proposed arrangement outlined in the Petition between the Petitioner and the Company employing the Stop Smoking Program does not constitute a kickback nor is it prohibited in any way by Section 458.331(1)(i), Florida Statutes.
