RULE NO.:RULE TITLE:
11B-35.0010eLearning Instruction
The Department of Law Enforcement hereby gives notice:
On November 6, 2014, pursuant to notice, at a meeting held in Kissimmee, Florida the Criminal Justice Standards and Training Commission considered a petition for a one-year temporary waiver of subsection 11B-35.0010(1), F.A.C., by Colonel David H. Brierton of the Florida Highway Patrol on behalf of the Florida Department of Highway Safety and Motor Vehicles. After careful consideration of the facts in this matter, the Commission found that Petitioner had demonstrated an economic, technological, legal, or other type of hardship resulting from strict application of subsection 11B-35.0010(1), F.A.C., that was particular to petitioner, significantly different from the way the rule affects other similarly situated persons and issued an order granting Petitioner’s petition for a one-year waiver of subsection 11B-35.0010(1), F.A.C.
