    NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received a petition for declaratory statement from Michael R. Kassower, Esq., In Re: Coronado at Highland Beach Condominium Association, Inc., Docket No. 2015049413, filed on November 4, 2015. The petition seeks the agencys opinion as to the applicability of Section 718.113(2)(a), Florida Statutes, as it applies to the petitioner.

    Whether the replacement of the pine wood bridge with a pressure treated pine wood constitutes a material alteration pursuant to Section 718.113(2)(a), Florida Statutes, and therefore requires a vote of the membership? Whether the replacement of the pine wood bridge with Trex materials constitutes a material alteration pursuant to Section 718.113(2)(a), Florida Statutes, and therefore requires a vote of the membership? Whether the addition of wheelchair ramps and wheelchair observation areas to the bridge as part of the replacement bridge constitutes a material alteration or substantial additions pursuant to Section 718.113(2)(a), Florida Statutes, and therefore requires a vote of the membership?
