    PURPOSE AND EFFECT: Revisions to Chapter 62-6, Florida Administrative Code, (F.A.C.), are needed to update regulations for the onsite sewage treatment and disposal systems (OSTDS) in Florida. This rulemaking is part of the ongoing rulemaking amendments for Chapter 62-6, F.A.C., published in the Florida Administrative Register, Volume 48, Number 128, on July 1, 2022. The revisions proposed will update compliance standards, and definitions in rule 62-6.001, F.A.C. Also, this rulemaking will create a new rule 62-6.024, F.A.C., relating to enforcement and auditing for private provider inspections of the OSTDS as directed by Chapter 2022-105, Laws of Florida.

    SUBJECT AREA TO BE ADDRESSED: The Department is proposing amendments to Chapter 62-6, F.A.C., entitled Standards for Onsite Sewage Treatment and Disposal Systems. Amendments to the rule will update rule 62-6.001, F.A.C., to remove incorporation of the Form DEP 3146, 11/02, Citation for Violation, Onsite Sewage Program/Sanitary Nuisance, and update regulatory requirements due to statutory changes affecting Chapter 62-6, F.A.C. Additionally, the Department will create a new rule 62-6.024, F.A.C., to adopt rules for the enforcement and auditing requirements pursuant to the private provider inspections of an OSTDS as directed by Chapter 2022-105.
