NOTICE IS HEREBY GIVEN that the Department of Financial Services, Division of Accounting and Auditing, Bureau of Unclaimed Property (the “Department”), received a Petition for Declaratory Statement (the “Petition”) from Choice Plus LLC on November 10, 2015. The Petition seeks the Department’s opinion regarding: (1) the Department’s method for determining whether a fee is a “flat fee” under Sections 717.135 and 717.1351, Florida Statutes; and (2) the specific statutory, regulatory, common, and case law bases for the Department’s authority to examine a claimant’s representative’s prior claims in order to determine whether a fee in the instant claim is a flat fee.
