NOTICE IS HEREBY GIVEN that the Florida Office of Financial Regulation has issued an order disposing of the petition for declaratory statement filed by Time Out Market (Miami) LLC on August 31, 2018. The following is a summary of the agency's disposition of the petition:

On 8/31/2018. the Florida Office of Financial Regulation (Consumer Finance) received a Petition for Declaratory Statement from Time Out Market (Miami) LLC. The petition sought a declaratory statement from the Office on whether its proposed business model (to operate three bars within a food hall and offer customers a prepaid card provided by the company in exchange for cash for consumers who do not have or do not wish to use a debit card or credit card) falls under the Florida Money Transmitter Statute, Chapter 560, Florida Statutes. On 11/16/2018, the Office issued a Final Order on the Petition for Declaratory Statement. The Office determined that under the circumstances described, proposed activities require a license pursuant to Part II of Chapter 560, Florida Statutes.
