40E-6.011: Policy and PurposeNOTICE IS HEREBY GIVEN THAT on November 8, 2007, the South Florida Water Management District (District), received a petition for waiver from Olimpia T. Ruiz, Application No. 07-1108-1 for issuance of a Right of Way Occupancy Permit for utilization of Works or Lands of the District known as the C-4, Miami-Dade County, to allow a proposed fence enclosure to encroach 8.5' within the north right of way of C-4 adjacent to 651 S.W. 130th Avenue, lying in Section 2, Township 54 South, Range 39 East. The petition seeks relief from subsections 40E-6.011(4) and (6), Florida Administrative Code, which governs the placement of permanent and/or semi-permanent above-ground encroachments within 40 feet of the top of the canal bank.
