DEPARTMENT OF ENVIRONMENTAL PROTECTION

The Department of Environmental Protection hereby gives notice that on November 13, 2013, the Department of Environmental Protection has issued an order. The order is for the Charley Toppino & Sons, Inc. (Toppino) variance petition (OGC File No. 13-1239), received on October 4, 2013. The petition requested a fee reduction for processing construction permits for 36 Class V, Group 6 dewatering injection wells (subparagraph 62-4.050(4)(m)11., F.A.C.). Notice of receipt of this petition was published in the Florida Administrative Register, on October 16, 2013. No public comment was received. The final order granted a variance to Toppino to reduce the application fee to a total of $10,000.00. This variance was granted because the petitioner demonstrated a substantial hardship and that the purposes of the underlying statutes would be met with the conditions imposed by the Department.
