    PURPOSE AND EFFECT: Rule 69I-31.108, F.A.C., is being repealed because the manual adopted is exempted from rulemaking by Section 120.52(16)(c)2., F.S.

    Rule 69I-31.807, F.A.C., is being repealed because Rule 1.230 of the Florida Rules of Civil Procedure makes the rule unnecessary.

    SUMMARY: Rule 69I-31.108, F.A.C., adopts a payroll preparation manual for Florida employees.

    Rule 69I-31.807, F.A.C., states that the Florida Chief Financial Officer may intervene in garnishment proceeding. These rules are determined as unnecessary and are being repealed.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The absence of these rules has no impact. The payroll preparation manual still is in effect by operation of the exemption from the definition of “rule” found in Section 120.52(16)(c)2., Florida Statutes. Similarly, the party status of the Department is unaffected by the repeal of the rule.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.
