NOTICE OF CANCELLATION – The Department of Environmental Protection, Siting Coordination Officer announces a hearing to which all persons are invited.

DATES: November 27-28, 2006

PLACE: OUC Pershing Avenue Complex, Safety Training Room, First Floor, Electrical Distribution Building, 6003 Pershing Avenue, Orlando, Florida

GENERAL SUBJECT MATTER TO BE CONSIDERED: The certification hearing scheduled for November 27-28, 2006, and noticed on October 6, 2006, has been cancelled. In accordance with the Florida Electrical Power Plant Siting Act, Section 403.527(6), F.S., on October 19, 2006, all parties to this proceeding stipulated that there are no disputed issues on material fact or law to be raised at the certification hearing. On October 30, 2006, the Department filed a request to cancel the certification hearing and relinquish jurisdiction to the Department of Environmental Protection pursuant to Section 403.508(6)(a), F.S. On October 31, 2006, Administrative Law Judge Donald R. Alexander issued an order granting the request pursuant to Section 403.508(6)(b), F.S. Pursuant to Section 403.509(1), F.S., the Department of Environmental Protection shall prepare and issue a Final Order within 40 days of the Judge’s Order.
