64B17-3.001Licensure as a Physical Therapist by Examination

The Board of Physical Therapy hereby gives notice:

Of the issuance of an Order regarding the Petition for Variance, filed on June 11, 2013, by Martina Lohouse. The Notice of Petition for Waiver or Variance was published in Vol. 39, No. 120, of the June 20, 2013, Florida Administrative Register. Petitioner sought a waiver or variance of Rule 61J1-3.001, F.A.C., which requires that an applicant with or licensure as a Physical Therapist by Examination.

The Board’s Order, filed on August 29, 2013, denies the petition for Variance or Waiver of Rule 64B17-3.001, F.A.C. The Board is only authorized to grant a Variance or Waiver of the Board’s rules, and do not authorize the Board to waive a statutory requirement. Accordingly the Board is without jurisdiction to grant the Petition for Variance or Waiver. Petitioner’s application will be placed on hold to allow her to provide an updated or revised evaluation of her education credentials.
