    NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received a petition for declaratory statement from Stephen Lowery, Esq., In Re: Bahama Bay Club Townhomes Condominium Association of Gulf Breeze, Inc., Docket No. 2015050643, filed on November 18, 2015. The petition seeks the agencys opinion as to the applicability of Section 718.111(13), Florida Statutes, as it applies to the petitioner:

    Whether the financial reporting requirements of Section 718.111(13), Florida Statutes, controls the financial reporting obligations of the Association on account of the inclusion of Kaufman language in the Bylaws and notwithstanding section 6.7 of the Association’s Bylaws, which requires a yearly audit.
