NOTICE IS HEREBY GIVEN that the Department of Financial Services, Division of State Fire Marshal has received the petition for declaratory statement from Petition for Declaratory Statement filed on November 2, 2012, from Wesley Hayes. The petition seeks the agency's opinion as to the applicability of Florida Statutes Chapter 633 which incorporates NFPA 101, Chapter 30 as it applies to the petitioner.
This petition for declaratory statement refers to a building that contains four units each with two stories. Petitioner presents the following question as to whether the building is classified as a townhouse, and if so, whether the Code allows fire safety inspections of the required fire separation between units.
