    NOTICE IS HEREBY GIVEN that the Board of Accountancy has issued an order disposing of the petition for declaratory statement filed by Kenneth R. Hart, Esq., on behalf of Antonio L. Argiz C.P.A., P.A., (“Argiz PA”) on November 22, 2019. The following is a summary of the agency's disposition of the petition:

    On August 20, 2019 the Petitioner filed a Second Amended Petition for Declaratory Statement, seeking the Board’s opinion as to the applicability of Section 473.309, F.S., as it applies to the petitioner. Petitioner inquired whether after the transfer of 49% of the stock in Argiz PA to an irrevocable trust based on the circumstances outlined in the petition will comply with Section 473.309, F.S. The Notice of the Second Amended Petition for Declaratory Statement was published in Vol.45, No.164, on August 22, 2019, in the Florida Administrative Register. No comments were received on the Petition. The Board, at its meeting held on October 18, 2019, voted to grant the Second Amended Petition for Declaratory Statement finding that for the limited purpose of the Petition and specific terms outlined therein, Petitioner will be in compliance with Section 473.309, F.S., and applicable Florida laws regarding the practice of public accounting.
