    PURPOSE AND EFFECT: At its September 2016 meeting, the Commission approved proposed rules for gray triggerfish to decrease the Atlantic recreational and commercial minimum size limits, as well as the statewide importation and sale minimum size limit, from 14 inches to 12 inches fork length, and to establish a 10-fish recreational bag limit in Atlantic state waters.

    The proposed rule amendment would clarify that the recreational and commercial minimum size limit approved by the Commission for Atlantic gray triggerfish is measured by fork length. The effect of the proposed rule would be to provide additional guidance to harvesters on the how the 12-inch size limit is measured.

    SUMMARY: This proposed rule would clarify that the recreational and commercial minimum size limit for the gray triggerfish in Atlantic state waters is measured by 12 inches fork length.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: the nature of the rule and the preliminary analysis conducted to determine whether a SERC was required.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    No person shall land, possess, unnecessarily destroy, purchase, exchange, sell or offer for sale any of the following species harvested in or from state waters, of a length less than set forth as follows:

    (1) through (2) No change.

    (3) Gray triggerfish.

    (a) Gray triggerfish harvested in the Atlantic Ocean 12 inches fork length.

    (b) No change.

    (4) through (7) No change.
