NOTICE IS HEREBY GIVEN that the Florida Office of Financial Regulation has declined to rule on the petition for declaratory statement filed by Southern Trust Mortgage, LLC. on September 17, 2019. The following is a summary of the agency's declination of the petition:

On November 26, 2019, the Florida Office of Financial Regulation issued a Final Order on Petition for Declaratory Statement. The Petition is DENIED. The Office determined that the Petition does not provide the Office with enough information to determine whether Petitioner is a substantially affected person, such that Southern would be a proper party to request a declaratory statement for itself and for its loan originator employees under section 120.565, Florida Statutes and chapter 28-105, Florida Administrative Code, because the Petition does not affirmatively state whether Southern and its employee loan originators are presently engaged in making soliciting, offering to solicit, accepting or offering to accept applications, or negotiate the terms of mortgage loans in Florida. Any further analysis is unnecessary, and the Office therefore makes no determination regarding the merits of Petitioner's request.. ******The original petition was published September 20, 2019 in the Florida Administrative Register Volume 45, Number 184.
