59G-13.070: Developmental Disabilities Individual Budgeting Waiver Services
NOTICE IS HEREBY GIVEN that on November 10, 2016, the Agency for Health Care Administration, received a petition for Variance from or Waiver of Rule 59G-13.070, F.A.C, (“Petition”) on behalf of the Petitioner, Attain Inc. Rule 59G-13.070 of the Florida Administrative Code (“Rule”) applies to all providers of Developmental Disabilities Individual Budgeting Waiver services who are enrolled in the Florida Medicaid program and requires that all providers of Developmental Disabilities Individual Budgeting Waiver services enrolled in the Florida Medicaid program be in compliance with the provisions of the Florida Medicaid Developmental Disabilities Individual Budgeting Waiver Services Coverage and Limitations Handbook, September 2015 (“Handbook”). Petitioner seeks a variance from or waiver of limited provisions of the Rule, which incorporates the Handbook by reference. Petitioner seeks a variance from or waiver of the Handbook provision on page 1-21, Qualifications for Residential Habilitation, requiring agencies to hire direct care providers who have one year of experience working in a medical, psychiatric, nursing, or child care setting, or experience working with recipients with developmental disabilities. Petitioner also seeks a variance from or waiver of the Handbook provision on page 2-55 and 2-56, Who Can Provide Residential Habilitation (Intensive Behavior), requiring direct care staff providing residential habilitation intensive behavior services in a licensed residential facility to have one year of experience providing direct services in a medical, psychiatric, nursing, child care setting, or working with persons who have a developmental disability. Interested persons or agencies may submit written comments on the Petition within fourteen (14) days after publication of this notice.
