    NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received a petition for declaratory statement from Mark D. Friedman, Esq., In Re: The Imperial House, Inc., Docket No. 2016053900, filed on November 22, 2016. The petition seeks the agencys opinion as to the applicability of Section 719.104(3), Florida Statutes, as it applies to the petitioner.

    What constitutes the interior of the unit, as addressed in Petition for Declaratory Statement Aloha Kai Association, Inc. (DS 2006-013)? Is the Association required under Section 719.104(3), Florida Statutes and its governing documents to provide property, casualty, fire, and flood insurance on wall coverings, floor coverings, ceiling coverings, countertops, cabinets, and upgrades within the interior of the unit boundaries? If question 2 is answered in the affirmative, can the Association change this requirement by amending its governing documents?
