NOTICE IS HEREBY GIVEN THAT the Department of Financial Services, Division of State Fire Marshal has received the petition for declaratory statement from Eagle Aviation, LLC. The petition seeks the agency’s opinion as to the applicability of Florida Building Code – Section 311 (Storage Group S), Florida Building Code – Chapter 5 (General Building Heights and Areas), Florida Building Code – Chapter 7 (Fire – Resistance – Rated Construction), NFPA 101 – Chapter 8 (Features of Fire Protection), NFPA 101 – Chapter 42 (Storage Occupancies), NFPA 409 Chapter 3 (Definitions), NFPA 409 – Chapter 4 (Aircraft Hangar Groups), NFPA 409 – Chapter 8 (Group III Aircraft Hangars), as it applies to the petitioner.

Petitioner believes that their interpretation of NFPA 409 is correct and is substantiated by a previous Declaratory Statement by the State Fire Marshal in Case No. 43365-01-SP. The local Authority having jurisdiction’s interpretation would require fire sprinklers even though not required by code.
