NOTICE IS HEREBY GIVEN that the Florida Real Estate Commission has issued an order disposing of the petition for declaratory statement filed by Matthew Kwasman, Esquire on June 8, 2018. The following is a summary of the agency's disposition of the petition: The Notice of Petition for Declaratory Statement was published in Volume 44, No. 117, of the June 15, 2018, Florida Administrative Register. The Petitioner sought a Declaratory Statement from the Commission with regard to paragraph 475.25(1)(h), Florida Statutes, which applies to sharing a commission with, or paying a fee or other compensation to a person not properly licensed as a broker, broker associate, or sales associate under Chapter 475, Florida Statutes. The Florida Real Estate Commission considered the Petition at a duly-noticed public meeting held on July 18, 2018, in Orlando, Florida. The Commission declined to answer the questions presented in the petition and denied the petition.
