    61G2-2.0031Delinquent Status

    The Board of Auctioneers hereby gives notice of the issuance of an Order regarding the Petition for Variance initially filed on March 8, 2014, by Richard Slajchert and finalized with the Board on May 22, 2014. The Notice of Petition for Variance or Waiver was published in Vol. 40, No. 101, of the June 27, 2014, Florida Administrative Register. The Petition did not state for which Rule the Petitioner was seeking a Variance or Waiver. However it appeared that the Petitioner was requesting a Variance or Waiver from paragraph 61G2-2.0031(3)(b), F.A.C., which requires the licensee to pay delinquent status license fee.

    The Board’s Order, filed on August 26, 2014, denies the petition, finding that the petition was in substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code. Petitioner has not established that the Board’s full application of paragraph 61G2-2.0031(3)(b), F.A. C., to his circumstances would violate principles of fairness nor shown a substantial hardship.
