On October 29, 2015, an Order was issued Granting the Petition for Waiver of Florida Administrative Code Rule 61A-3.039 filed by Petitioner, Publix Supermarkets, Inc. on July 30, 2015. Based on the information provided by the Petitioner, the Division concludes that the Petitioner’s request for variance meets the burden of demonstrating that the purposes provided by Rule 61A-3.039, F.A.C., will otherwise be met, and that the application of the rule would rules would result in substantial hardship to Petitioner.
