NOTICE IS HEREBY GIVEN that on October 21, 2024, the Agency for Persons with Disabilities, received a petition for a variance for paragraph 65G-2.009(7)(d) of the Florida Administrative Code. The rule language for which the variance is sought states, "[t]he use of remote interactive video monitoring shall be limited to vocational and educational settings, medical and special treatment spaces, administrative offices, or common areas. Remote interactive video monitoring may not be used in bedrooms or bathrooms." Jamie Lekites, BCBA, of The Arc Tampa Bay for Safety Harbor Group Home, is seeking a variance from this rule to allow the use of video monitoring within a resident's bedroom.
