PURPOSE AND EFFECT: The proposed amendment is to remove paragraph (4)(d) because it is no longer necessary.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.
The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board, based upon the expertise and experience of its members, determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

61G18-30.003 Citations.
(1) through (3) No change.
(4) Pursuant to Section 455.224, F.S., the Board sets forth below those violations for which there is no substantial threat to the public health, safety, and welfare; or, if there is a substantial threat to the public health, safety, and welfare, such potential for harm has been removed prior to the issuance of the citation. The Board hereby designates the following as citation violations which shall result in a penalty of five hundred dollars ($500.00) unless otherwise noted:
(a) through (c) No change.
(d) Failure to respond to the self-inspection audit as required by subsection 61G18-15.005(3), F.A.C., prior to the date of license renewal.
(d)(e) Practicing veterinary medicine or operating a veterinary establishment when the license has become delinquent.
(e)(f) Failure to notify the Board of a change in responsible veterinarian.
(f)(g) Failure to obtain or complete the continuing education required for licensure renewal within the biennium. The licensee shall be required to complete the hours needed within 6 months of the date of issuance of the citation. These hours shall not be used for license renewal during the biennium in which they were earned.
(g)(h) Signing and distributing to others invalid or incomplete official certificates of veterinary inspection for the intrastate sale of dogs or cats.
(h)(i) Operating a veterinary establishment without a premises permit for more than 60 days but less than one year. The fine shall be $100 per month, to a maximun of $1,200.
(5) through (7) No change.
