NOTICE IS HEREBY GIVEN that Agency for Health Care Administration has received the petition for declaratory statement from Bioventus, LLC. The petition seeks the agency’s opinion as to the applicability of paragraph 59A-25.002(1)(e), Florida Administrative Code, as it applies to the petitioner.

To determine: 1) whether petitioner’s sales representatives’ residences that house petitioner’s inventory may be licensed as Home Medical Equipment providers; and, 2) whether petitioner’s sales representative can possess inventory of petitioner’s product that is not for a specific customer.
