The Board of Clinical Social Work, Marriage and Family Therapy and Mental Health Counseling hereby gives notice: of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on March 14, 2017, by Allison Konovalova. The Notice of Petition for Waiver or Variance was published in Volume 43, Number 52, of the March 16, 2017, Florida Administrative Register. The Petitioner was seeking a waiver or variance of paragraph 64B4-21.007(1)(d), F.A.C., entitled, “Definition of a Licensed Marriage and Family Therapist with at Least Five Years Experience or the Equivalent, Who Is a Qualified Supervisor," which states that a licensed marriage and family therapist, who is a qualified supervisor, as used in paragraph 491.005(3)(c), F.S., is defined as an individual who, during the period for which the applicant claims supervision is licensed as a clinical social worker or mental health counselor in Florida, or in the state in which the supervision took place, and can document a minimum of six (6) semester or eight (8) quarter hours of graduate coursework in marriage and family systemic theories and techniques, and five (5) years of clinical experience in marriage and family therapy, two (2) years of which can be earned during a post-masters clinical internship.
The Board considered the instant Petition at a duly-noticed meeting, held May 11, 2017, in Orlando, Florida. The Board’s Order, filed on June 8, 2017, granted the petition finding that Petitioner had established that the purpose of the underlying statute would be met by granting a variance or waiver from paragraph 64B4-21.007(1)(d), F.A.C. The Board further finds that Petitioner established that applying the requirements of the aforementioned rule to her circumstances would violate principles of fairness and impose substantial hardship.
